Terms of Service & Refund Policy

Read these three things before anything else.
1. ClassifiedTrades is an educational publisher. We are not a broker, not a financial adviser, and not registered as an investment adviser. Nothing we publish is a recommendation to buy or sell anything, and nothing is tailored to you.
2. All sales are final. We do not offer refunds — see Refund Policy below.
3. Trading is risky. Most people who day trade lose money, and you can lose more than you expect. Results are not typical and will vary.

1. Agreement & eligibility

These Terms govern your use of classifiedtrades.com, the members room, our alerts, and everything else we publish (together, the "Service"). By using the Service or purchasing a membership, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old. You are responsible for complying with the laws that apply to you, and for your own equipment and internet access. The Service is intended for residents of the United States; if you access it from elsewhere you do so at your own risk and are responsible for local compliance.

2. What this service is

ClassifiedTrades publishes educational trading alerts and commentary about small-cap and momentum stocks. An alert states a price level we find interesting, a stop, and target prices. It is a published observation, not an instruction and not a trade executed on your behalf.

We are not a registered investment adviser. We do not manage money, hold customer funds, execute trades, or provide personalised investment advice, and we do not accept compensation for recommending specific securities. We publish impersonal, general-circulation educational commentary and rely on the publisher's exclusion from the definition of "investment adviser" under Section 202(a)(11)(D) of the Investment Advisers Act of 1940 and equivalent state provisions. Nothing we publish is tailored to the financial situation, objectives or risk tolerance of any individual, because we do not know them.

3. Not investment advice

Nothing on the Service is a recommendation, solicitation or offer to buy or sell any security, nor a statement that any security or strategy is suitable for you. We give no legal, tax or accounting advice. Every decision you make about buying or selling is yours alone, and you are solely responsible for it and for its consequences.

We may hold, buy or sell positions in securities we mention, at any time and without notice, and our timing may differ from any alert. We are under no obligation to disclose our positions or to trade consistently with anything we publish.

4. How our results are measured — and their limits

We publish our alert history openly, and we want you to understand exactly what those numbers are and are not.

Published figures are derived from market data, not from executed trades. After an alert, we compare the called entry and targets against subsequent price data and record what price did. A call counts as a trade only once price reached the called entry; calls that never reached it are reported separately and excluded from hit rates. "Peak move" means the best price reached after entry — not a return anyone realised.

These are not member results. We do not track member accounts and have no access to anyone's brokerage statements. We make no claim about what any member earned or could earn. Because these figures are calculated rather than traded, they carry the inherent limits of hypothetical performance: they do not account for commissions, fees, slippage, partial fills, position sizing, taxes, trading halts, the liquidity available at any given moment, or the emotional and practical difficulty of executing in real time. Hypothetical results are also prepared with the benefit of hindsight. No representation is made that any account will or is likely to achieve comparable results. Results are not typical and will vary. Past performance is not indicative of future results.

5. Risk disclosure

Trading securities involves a high degree of risk and can result in the loss of your entire investment. Only trade money you can afford to lose entirely, and never money allocated to living costs, retirement, education, debt or a mortgage. Most people who day trade lose money.

6. Membership & billing

Membership is $499.95 per month, billed through PayPal. Payment is taken when you subscribe and automatically on each renewal until you cancel. We never see or store your card details — PayPal handles payment entirely. Prices are exclusive of any taxes, which are your responsibility.

We may change pricing or modify, suspend or discontinue any part of the Service at any time. Where a price change affects an existing membership, it applies from your next renewal.

It is your responsibility to keep a valid payment method on file. If a payment fails, we may suspend or terminate access immediately.

7. Refund policy — all sales are final

We do not offer refunds. All payments for membership, including renewal payments, are final and non-refundable. This applies without exception, including where you are dissatisfied with the Service, where you did not use it, where your trades were unprofitable, or where you forgot to cancel before a renewal date.

We are able to price the Service as we do precisely because it is sold on these terms. Because membership grants immediate access to alerts as they are published, the value is delivered the moment you join and cannot be returned.

Please decide before you buy, not after. Our full alert history, weekly results including losing weeks, and the calls that never triggered are published free on this site so you can evaluate the Service without paying. If you are unsure, do not purchase.

Initiating a chargeback or payment dispute instead of cancelling is a breach of these Terms and will result in immediate and permanent termination of access.

8. Cancellation

You may cancel at any time, and you should do so before your next renewal date to avoid being charged again. Because billing runs through PayPal, cancel the recurring payment in your PayPal account (Settings → Payments → Manage automatic payments), or email us at groundfloorentry@classifiedtrades.com and we will confirm cancellation.

Cancelling stops future charges. It does not refund payments already made, and access ends at the close of the period you have paid for. We may also terminate or suspend access at our discretion if you breach these Terms; no refund is due in that case.

9. Acceptable use & licence

Your membership is personal to you. We grant you a limited, revocable, non-transferable licence to access the Service for your own individual use only. You may not:

Sharing alerts is the breach we take most seriously, and it results in immediate termination without refund. All content, charts and materials remain our property.

10. Members room conduct

The members room is hosted on Discord. Do not harass or abuse anyone, post unlawful or offensive material, promote securities, solicit other members, share anyone's personal information, or give personalised financial advice to other members. Comments by members are their own opinions, not ours, and we do not verify or endorse them. We may remove content and remove members at our discretion.

11. Third-party services

The Service relies on third parties including PayPal, Discord and Telegram, each governed by its own terms. Links to other sites are not endorsements, and we are not responsible for their content or availability. Market data used to score our alerts comes from third-party providers; we do not guarantee its accuracy, completeness or timeliness.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT ALERTS WILL BE DELIVERED WITHOUT DELAY, THAT ANY DATA OR INFORMATION IS ACCURATE OR COMPLETE, OR THAT ANY RESULT WILL BE OBTAINED FROM USE OF THE SERVICE. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLASSIFIEDTRADES AND ITS OWNER, OPERATORS, CONTRACTORS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY TRADING LOSSES, LOST PROFITS, LOST OPPORTUNITY, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO THE SERVICE, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING HERE LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

14. Indemnification

You agree to indemnify and hold harmless ClassifiedTrades and its owner, operators, contractors and affiliates from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Service, your trading decisions, your breach of these Terms, or your violation of any law or third-party right.

15. Privacy

Our Privacy Policy explains what we collect and how it is handled. In short: no analytics, no cookies, no tracking, and we store almost nothing.

16. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed, and continued use of the Service after a change means you accept the updated Terms. If a change materially affects your rights, we will make reasonable efforts to notify members.

17. Governing law, arbitration & class-action waiver

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

Please read this section carefully — it affects how disputes are resolved. You and ClassifiedTrades agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in the State of Texas, rather than in court. The Federal Arbitration Act governs this section.

YOU AND CLASSIFIEDTRADES EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

Two exceptions: either party may bring a qualifying claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property. Before starting arbitration, please email us at groundfloorentry@classifiedtrades.com with a description of the dispute and the relief sought — most issues are resolved this way, and we ask for 60 days to try. If the class-action waiver above is found unenforceable, this entire arbitration section is void.

18. General

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms; we may assign them in connection with a transfer of the business. Sections that by their nature should survive termination will survive.
